Facts & Background:

  • Pravin Electricals Pvt. Ltd., which operated in key industrial and commercial retail sectors, provided electrical supplies and services and was the Appellant.
  • Galaxy Infra and Engineering Pvt. Ltd., incorporated under the Companies Act, 1956, with its registered office in Bihar, was engaged in providing consultancy services and was the Respondent.
  • The Respondent claimed it had facilitated the Appellant in securing a contract with the South Bihar Power Distribution Company Ltd. (SBPDCL) under a Consultancy Agreement dated 7th July, 2014.
  • Disputes arose over the existence and execution of the agreement and payments, leading to the Appellant denying the agreement and the Respondent demanding arbitration.
  • The case was initially filed under Section 11(6) of the Arbitration and Conciliation Act, 1996, seeking the appointment of a Sole Arbitrator. The Delhi High Court, after reviewing the case and documentary evidence, appointed a Sole Arbitrator to adjudicate the dispute.
