Facts:

  • J.R. Kapoor (Appellant) was the founder of a business M/s. Microtelmatix, with the trade name "MICROTEL".
  • The M/s. Micronix India (Respondent), produced and sold electronic products under the "MICRONIX" trademark, featuring a black and white logo with 'TM' and 'I' inside the 'M' since September 21, 1977.
  • Originally, they were partners in a firm called M/s. Micronix India which produced and sold electrical and electronic products including cable TV and aerial boosters.
  • The partnership dissolved on February 14, 1992, as per a consent order in Suit No. 494 of 1991 in the Court of Sub-Judge, Delhi.
  • Post-dissolution, the Appellant-Defendant started M/s. Microtelmatix which had "MICROTEL" as the trade name with a unique 'M' logo, designed in blue and red colours.
  • The Respondent-Plaintiff filed the original suit in the High Court of Delhi and sought an injunction to prohibit the use of the trade name 'MICROTEL', the logo 'M', and the packaging carton. The learned Single Judge granted the injunction.
  • The Appellant sought to grant permission to raise an Appeal challenging the interim order passed by the Single Judge Bench at the Delhi High Court.

Background:

The Appellant-Defendant raised an Appeal before the Division Bench against the injunction passed by the Single-Judge Bench, but it was dismissed. Hence, the Appeal was filed by Special Leave in the Supreme Court.
